I think your premise is true in terms of what eBay is "trying to police", but they have a long way to go in terms of consistently applying the practice (as you also seem to suggest). They way to apply their practice, just creates a lot of confusion in the implementation. If applied consistently, I think it can make alot of sense, but if it's going to be haphazardly applied I don't see the point. They should hire "Peggy" and put her (him) to work on it.
